Indemnity and Privacy Policy

1. Introduction

This policy provides details about the practices that protect the privacy of the personal information of individuals who use Alex’s Gluten Free Spots (AGFS) app.

This document and the procedures it describes will be reviewed regularly and updated as necessary to ensure up-to-date practices.

2. Indemnity

Everyone with special dietary needs must always dine defensively — in restaurants it is especially tricky. Many restaurants will say they offer a pizza with a gluten free crust. Does that mean that the toppings are OK and the pizza was prepared in an non-contaminated environment? Do you trust a waiter or manager who does not know the difference between a “gluten free pizza” and a “gluten free crust”? Personally, I do not. But that is beside the point — my goal is to work with others to present all of the possible options to you and let you decide what goes into your body. That being said, this app and website are intended to act as a general guide. Since ratings and reviews are included from other users and cannot be fully guaranteed, you must know that the information in this app and on our website cannot and must not be fully trusted. You agree that by using this app, you understand that you are taking a risk and will not seek any legal remedy whatsoever from any consequences you face due to information provided in this site. Quite simply, while we’re doing the best we can to provide you with a nice network of opinions, ratings and reviews to help you in your search for a gluten-sensitive dining experience, you still need to be 100% responsible for the consequences of any food you eat or drink. So be careful.

3. Limits on Collection, Use, and Retention of Personal Information

AGFS’s goal is to collect, sort, and disseminate information about resources, services, events, and places relating to gluten-free eating. In order to help us fulfill this mandate, we may collect personal information from people who have 1) expressed an interest in gluten-free places (such as name, address, telephone number, and email address), and 2) have agreed to willingly provide such information. AGFS is then able to distribute gluten-free and related information to these individuals. AGFS may also publish the business contact information of related businesses on its website in order to help those who have gluten-free requirements to locate gluten-free places in their area.

AGFS is occasionally involved in work that requires the collection and use of information on gluten-free lifestyles and experiences and/or the demographics of the participants. By participating in a survey, you consent to our collecting your personal information. When we publish information, it is usually of a general nature, but if it includes identifying details such as your name and address, we will ask for your explicit permission.

You can visit our website without telling us who you are or revealing any identifying details about yourself. However, using Google Analytics, AGFS automatically collects general information about each person’s visit to our website, including basic demographic data (such as country of origin) and browsing patterns (such as number of pages visited and length of time spent browsing). This information is used only in aggregate form; no individual visitor is ever identified.

4. Limits on Disclosure

We do not rent, sell, or trade mailing lists or other personal information of our users. From time to time, gluten-free organizations ask for AGFS’s help in distributing information that may be of interest to the gluten-free community. In that case, AGFS administers the mail-out in order to protect your privacy. We do not provide access to our mailing list.

If researchers ask AGFS to share information that was collected for a different purpose, AGFS will ask the individuals involved to consent to their personal information being used for the new purpose.

5. Website and Electronic Commerce

AGFS meets industry standards for technological security. AGFS houses and maintains websites, databases and apps owned and possibly operated by third parties. The owners of these sites may deal with the collection, use and disclosure of personal information differently than we do, and may have their own privacy policies. What’s more, your ratings and reviews may appear on related third party apps, as their databases may be connected to ours.

AGFS and the websites it houses/maintains also provide links to other websites outside of its domain. Any links provided to these websites are provided solely for your convenience.

We encourage you to review the privacy policies of these third party websites, within and outside the AGFS domain, and direct any questions you may have to the owners of those websites before disclosing your personal information. AGFS will not be liable under any circumstances for any damages arising from these third party websites.

6. Access and Rights

At any time, you may opt out altogether of having us collect, use, or disclose your personal information, subject to reasonable notice and applicable laws. If you want to do this, please contact the AGFS Privacy Officer. Remember, if you withdraw or refuse to provide consent, we may be unable to provide some information or services to you.

You have the right to ask if AGFS holds any personal information about you, to ensure that it’s accurate and to have access to it, as provided by law. You also have the right to know how we are using your information.

To protect your privacy, we will take reasonable steps to verify your identity before granting you access to, or making corrections to, your personal information.

You may also register a privacy-related complaint by contacting AGFS’s Privacy Officer. We will investigate all complaints. If an objection is justified, we will take appropriate steps to repair the situation, including changing our policies and practices if necessary.

The law sometimes permits or requires that organizations collect, use, or disclose information about you without your consent, or withhold information in certain circumstances. AGFS will comply with the law.

7. Your California privacy rights

If you are a resident of California, you have the right to request information from us once every calendar year regarding the manner in which we share certain categories of personal information with third parties for their direct marketing purposes. We may provide this information in any format at our discretion which may not be specific to you.

8. Children’s privacy

AGFS is not intended for use by children under the age of 13. We recognize that children under the age of 13 may not fully understand the consequences of submitting personal information on our Properties. Therefore, we encourage parents to supervise the online activities of their children and educate them on the responsible use of the Internet. We do not knowingly allow children under age of 13 to register for any service, and we do not knowingly collect any personally identifiable information from children under age of 13.
